Texas THC laws have changed under House Bill 46, bringing patients more options for relief with medical cannabis. For years, patients in the Texas Compassionate Use Program were limited to medical cannabis products containing no more than 1% THC by weight. This requirement restricted the types of products licensed medical marijuana dispensaries could offer. Now, medical marijuana dispensaries in Texas can offer a variety of medical-grade THC options, including the first medical concentrates in Texas. What Amount of THC is Allowed in Texas? 

As of September 1, 2025, Texas removed the 1% THC by weight requirement and replaced it with a cap of 10 mg THC per dose and 1,000 mg THC per package. Physicians may prescribe patients up to a 90 day supply with up to four refills. There is no limit to the number of doses a physician may prescribe within the 90-day prescription to treat the patient's symptoms.
 
This update modernizes the program and expands the treatment options available for Texas medical cannabis patients. Moving to measuring THC by milligrams also aligns with how common medications are dosed and how other states with established programs measure THC.

Medical Cannabis Vaporization in Texas 

One of the most notable updates under House Bill 46 is the addition of medical vaporization. These types of products may provide quick relief for patients managing symptoms such as sudden pain, nausea, or anxiety associated with qualifying conditions.

A New Era of Medical Cannabis in Texas

House Bill 46 brings the most significant update to the Texas Compassionate Use Program since its creation in 2015. Texans with more than 150 qualifying conditions, including chronic pain, Crohn's disease, inflammatory bowel disease, traumatic brain injury and patients receiving hospice or palliative care, can now obtain a medical cannabis prescription.  
 
This new law also improves accessibility by allowing licensed dispensaries to store products at approved satellite locations across Texas, making them easier to access in more regions. Currently, patients can access medical cannabis at more than 18 pickup locations statewide.

What is the New Marijuana Law in Texas?

The new marijuana law in Texas, House Bill 46, expands the state's medical cannabis program significantly. HB 46 added new qualifying conditions like chronic pain, allows for new product types, improves access statewide through satellite locations, removes the 1% THC cap and more. 

Is THC Recreationally Legal in Texas?

THC is not recreationally legal in Texas, but is legal for medical use for conditions such as chronic pain, PTSD, cancer and more. The Compassionate Use Program allows patients to get a medical cannabis prescription to access products such as THC gummies, concentrates, beverages, topicals, chocolates and tinctures. 

What is the New Law on Vaping in Texas?

In September 2025, Texas Senate Bill 2024 (SB 2024) went into effect, implementing several new restrictions on vape products in Texas. One of the restrictions makes it illegal to sell or market vape products containing cannabinoids such as Delta-9 THC. However, this restriction does not apply to regulated medical cannabis vaporization devices prescribed under the Texas Compassionate Use Program.

Under House Bill 46, Texas medical cannabis patients are legally allowed to use medically vaporized cannabis products when prescribed by a physician. Once approved, Texas Original medical vaporization devices will allow Texans more ways to find relief with medical cannabis.

How Can I Get a Medical Marijuana Card in Texas?

While Texas does not issue medical marijuana cards, eligible patients can still legally access medical cannabis through the Texas Compassionate Use Program. Instead of a medical card, licensed physicians enter a digital prescription into the Compassionate Use Registry of Texas.
