HB 46 brings critical improvements to Texas Compassionate Use Program that will benefit thousands of Texans
AUSTIN, Texas (July 8, 2025)—Texas Original, Texas’ leading medical cannabis provider, celebrates the passage of House Bill 46 and its critical improvements to the Texas Compassionate Use Program.
“Texas is long overdue to improve the Compassionate Use Program, which provides life-changing medicine to thousands of Texans. Now, we can reach thousands more,” said Nico Richardson, CEO of Texas Original. “We appreciate the legislature’s work advancing the bill and for creating a platform for physicians and patients throughout the state to reinforce the benefits of cannabis medicine.”
The bill drastically advances patient access throughout the state by:
- Adding new qualifying conditions, including conditions that cause chronic pain, traumatic brain injury, or a terminal illness or a condition for which a patient is receiving hospice or palliative care. Patients will not be required to use opioids first before qualifying for chronic pain.
- Allowing for satellite locations where medicine can be stored, reducing medicine costs and creating more availability for prescription pick-ups.
- Approving the use of aerosol or vapor as a means of administration. These medical products offer immediate relief, which is critical for patients with episodic conditions such as PTSD.
The bill will also align dosing with other prescription medications by capping THC by milligrams instead of by weight. This will reduce unnecessary filler ingredients in the medicine and support the addition of new delivery methods.
“Over the last several years, I’ve worked with more than 850 cancer patients who have drastically relieved symptoms associated with their treatments through medical cannabis,” said Dr. Louis Lux, medical director for palliative medicine and supportive oncology at Texas Oncology. “With the latest enhancements to the Compassionate Use Program, I can better serve my patients—and more of them—while providing new options for treatment such as medical vaporization. I want to express my gratitude to the Texas legislature for their support. The Compassionate Use Program has been very well run and monitored by the State of Texas. This bill will greatly impact the lives of countless Texans.”
House Bill 46 will go into effect on Sept. 1, 2025, and its provisions will be adopted on Oct. 1, 2025.
